AGREEMENT dated ____________________ between Lifesavers, Inc. 23809 E. Avenue J., Lancaster, CA 93535 (Lifesavers), and ______________________________________________________________________ (Adopter).
Whereas Adopter wishes to adopt certain Lifesavers, Inc. owned animal described as ___________________________________________________________ (Animal), the following terms and conditions shall apply:
a) Adopter agrees to be legally and financially responsible for providing proper care for Animal;
b) Adopter agrees to be responsible, as provided by state law, for any personal injury, property damage, or death caused by Animal in their care, for pursuing Animal that escapes or strays, and for costs of recapture;
c) Adopter shall not maliciously or negligently injure Animal, or cause Animal to be injured. Should accidental injury, or illness occur, Adopter agrees to have a veterinarian treat Animal and shall be responsible for all veterinarian fees;
d) Adopter agrees to a 3 (three) year home care trial period where they will care for adopted Animal either at their home or an approved boarding facility before receiving full title of ownership from Lifesavers;
e) Adopter agrees that title shall ownly be passed from Lifesavers if proper care has been given to Animal and all terms of this agreement have been satisfactorily met;
f) Adopter agrees that if any time during the home care trial period of adoption if Animal is found not being properly cared for, or Adopter is not fulfilling the terms of this agreement, the Animal may be repossessed by Lifeavers and adoption revoked;
g) Adopter agrees to notify Lifesavers immediately if they can no longer care for Animal during the home care trial period, at which time arrangements will be made to return Animal to Lifesavers.
h) Adopter agrees to provide Lifesavers photographs and other requested documents that prove the well being and proper care of Animal every 6 months during adoption trial period;
i) Adopter shall not breed Animal. Adopter agrees to have intact male adopted horse(s) castrated by licensed veterinarian at Adopter's expense;
j) Adopter shall not sell or transfer Animal to any other party or location during trial period;
k) Adopter agrees that following receipt of full ownership title from Lifesavers of Animal, if Adopter ever chooses to sell, transfer or giveaway their Animal they will give Lifesavers the first right of refusal to re-possess or purchase the previously adopted horse at a fair amount to be negotiated between both parties but not to exceed the amount of adoption donation under this agreement.
l) Adopter shall not treat Animal inhumanely;
m) Adopter shall not destroy Animal, or have Animal destroyed, except as an act of mercy, and under the attention and advice of veterinarian.
n) In the case of Animal's death, Adopter shall dispose of remains in accordance with applicable sanitation laws;
o) Adopter agrees that under no circumstances will Animal be sold or transferred to any slaughterhouse or person who sells animals to slaughter houses (including livestock auctions) at any time during the life of the Animal;
p) This agreement is binding under the laws of the state of California.
